OFFICIAL RULES, TERMS AND CONDITIONS
Diamond Air’s Ugly AC Contest is sponsored by Moreno Mechanical, LLC dba Diamond Air or Company. This contest is governed by these official rules (“Official Rules”). By participating in the promotion, each entrant agrees to abide by these rules, including all eligibility requirements and understands that the results of the contest, as determined by Diamond Air in its sole and exclusive discretion, are final in all respects. The contest is subject to all federal, state and local laws and is void where prohibited by law.

ELIGIBILITY
The contest is for owner-occupied, single-family homes with a central HVAC system currently installed. It is open to legal residents of the United States where not prohibited by law, who are 18 years or older and are permanently residing within the home in Guadalupe County. In addition, eligible contestants must have internet access and a valid and verifiable email address account prior to the beginning of the contest period.

Diamond Air has the right to verify the eligibility of each entrant, including requesting verification of residence by copy of utility bill, as well as visiting the nominee’s residence for a consultation regarding the unit installation. Diamond Air employees and their immediate families are not eligible to enter of win. Odds are based on number of entries.

CONTEST PERIOD
The contest begins March 11, 2024 and ends April 12, 2024, at 10:00PM CST.

HOW TO ENTER
Contestants can enter through the Diamond Air website at www.diamondairtexas.com and are eligible to receive one (1) A/C system including standard installation and manufacturer warranties and free one-time installation from Diamond Air.

SUBMISSION PERIOD
Visit Diamond Air website and follow the instructions to submit a nomination that describes why the nominee should receive a free A/C system, as well as a photo of both their current A/C and the nominee. The submission period is open from Monday, March 11, 2024 at 12:01 AM CST and ends Friday, April 12, at 10:00 PM CST. Diamond Air, in its sole and exclusive discretion, will determine eligibility of each submission to determine winner. Winner will be selected based on criteria including completion of nomination form which requires a photo of the nominee, a photo of the A/C unit, proof of permanent residency in Guadalupe County and availability to be interviewed by Diamond Air to determine condition and location of current HVAC unit. The winner will be selected by Diamond Air based on the criteria listed. Winner will be announced at a live Facebook drawing on April 19 and on the website and Facebook page. Diamond Air reserves the right to extend, shorten or terminate the contest at their sole discretion.

Finalists are required to give Diamond Air ample opportunities and access to physically inspect the home HVAC unit, including internal and external systems to determine if Diamond Air has the technical ability and legal authority to safely replace the unit without undue burden or cost exceeding $10,000. Finalists may be disqualified if their homes have poorly maintained or dangerous environments that could hinder proper and safe removal, installation and performance of the new unit, which include but are not limited to unsafe condition of the property or its inhabitants, including unrestricted pets, faulty electrical or gas systems, poorly maintained duct and systems work, and other technical issues. If a finalist does not meet all requirements, Diamond Air reserves the right to select a winner at the Company’s discretion.

WINNER SELECTION AND PRIZES
For this promotion Diamond Air will award one prize to one winner in Guadalupe County, Texas. The A/C unit will be installed according to the availability of the winner and Diamond Air after the conclusion of the contest April 19, 2024. The winner is eligible to receive one (1) A/C system including standard installation and manufacturer warranties and free one-time installation from Diamond Air. Diamond Air makes no representation or warranties, express or implied as to fitness for particular purpose, no service or duct work is included as part of the prize.

Participants do not need to be present to win and the winner will be contacted in person, via phone or email. In the event the winner cannot be reached and/or does not respond within a 48-hour time period from the time of initial outreach, they forfeit the prize, and another finalist shall be named a winner. In the event that no winners claim the prize pursuant to Diamond Air’s rules and regulations (including but not limited to any and all eligibility requirements) the prize will be donated to a nonprofit of Diamond Air’s choice.

Terms and conditions may apply. Incidental expenses and all other costs and expenses which are not specifically listed as part of the prize in these Official Rules, and which may be associated with the award, acceptance, receipt and use of all, or any portion of the awarded prize are solely the responsibility of the prize winner. Maintenance, repairs, or installation of duct work, or anything else that’s not part of the initial installation is not included and subject to an additional fee. Additional expenses include, but are not limited to, repairs needed on the home’s gas/electrical system to update it to current code requirements as listed by the state and federal government, expenses to replace eroded connection systems, damage occurred to poorly maintained connecting systems, or expenses to repair damaged walls. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE REPSONSIBILITY OF THE WINNER.

ADDITIONAL LIMITATIONS: Prize is non-transferrable. No substitution or cash equivalent of prize is permitted.

INDEMNIFICATION AND LIMITATION OF LIABILITY
By entering the contest, each entrant agrees to indemnify, release and hold harmless Diamond Air, the Facebook platform, administrator, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury resulting in whole or part, directly or indirectly, from that entrants participation in the contest, the rights of publicity associated therewith and the acceptance, use or misuse of any prize that may be won. Diamond Air disclaims any liability for damage to any computer system resulting from access to or the download of information or materials connected with the contest.

TAXES
Subject to IRS and other tax reporting, the winner is solely responsible for reporting and paying any and all applicable taxes related to the price and paying any expenses associated with any prize not specifically provided for in the official rules. The winner must provide the Company with valid identification and a valid taxpayer identification number or social security number, in the manner provided and/or requested by the Company, before any prize is awarded. Any person winning over $600 in prizes from the Company will receive an IRS Form 1099 after the end of the calendar year and a copy of such form will be filed with the IRS.

PUBLICITY
By participating, each entrant grants Diamond Air permission to use his/her name, likeness, business name or comments for publicity purposes without payment of additional consideration.
